- What policy argument supports the defendant in Herring – that is what problems might be created or exacerbated by the court’s ruling?
- With respect to GPS surveillance – much of the decisions here will ultimately be made in the state legislatures. So - if you were in the legislature state the circumstances – if any – that should justify e a public official or law enforcement agent to attach a gps to a private persons car without a warrant.
